Export Terms of Sale

By placing an order on Sidecuts®.com, you ("Buyer") agree to the following Export Terms of Sale. These terms form a binding agreement between you and Brown® Metals Company®. If you do not agree, do not complete your purchase.

1. Destination Control Statement. Items sold on Sidecuts®.com are subject to U.S. export control laws and regulations. The following statement applies to all items purchased:

These items are controlled by the U.S. Government and authorized for export only to the country of ultimate destination for use by the ultimate consignee or end-user(s) herein identified. They may not be resold, transferred, or otherwise disposed of, to any other country or to any person other than the authorized ultimate consignee or end-user(s), either in their original form or after being incorporated into other items, without first obtaining approval from the U.S. government or as otherwise authorized by U.S. law and regulations.

2. Identification of Responsible Parties. For purposes of these terms and all applicable U.S. export control laws, the "ultimate consignee" and "end-user" are the entities and individuals identified in the billing and shipping information you provide at checkout. By submitting that information, you represent that it is accurate and that the named parties are the actual purchaser, consignee, and end-user of the items. You and those named parties are jointly responsible for compliance with all applicable export, re-export, and transfer restrictions.

3. Buyer Representations. You represent and warrant that: (a) you are not located in, under the control of, or a national or resident of any country subject to U.S. embargo or comprehensive sanctions; (b) you are not listed on any U.S. Government denied-, restricted-, or debarred-party list (including the BIS Denied Persons List, the Entity List, and the OFAC SDN List); (c) you will not export, re-export, or transfer the items in violation of U.S. law; and (d) the items will not be used for any prohibited end-use.

4. Compliance Responsibility. You are solely responsible for obtaining any export license or authorization required for any subsequent transfer of the items, and for complying with the laws of any destination country. Brown® Metals Company® makes no representation that any required license will be granted.

5. Indemnification. You agree to indemnify and hold harmless Brown® Metals Company® from any claims, penalties, fines, or losses arising from your violation of these terms or of any applicable export control law.

6. Acceptance. Your acceptance of these terms is recorded when you check the box agreeing to the Export Terms of Sale at checkout and complete your order.
